Jurisdiction of the lands disputes tribunal

The land disputes tribunal is established by the Land Disputes Tribunals Act Cap 303 Laws of Kenya.

Under Section 3 of the Act, the tribunal hears and determines all cases of a civil nature involving any dispute as to the division of land, a claim to occupy land or trespass to land.

The tribunal adjudicates upon all civil cases and reaches a decision in accordance with recognized customary law. The hearings are presided over by a chairman and the decision is by simple majority.

Every registration district has a land disputes tribunal consisting of the chairman appointed by the District Commissioner from the panel of elders.
