Circumstances when a person shall not be regarded as having been deprived of his life in contravention of the provisions of the Constitution if he dies as a result of the use of force

Under the provisions of the Constitution of Kenya, a person is not regarded as having been deprived of his life, if he dies in the following circumstances:

  1. For the defence of any person from violence
  2. For the defence of property
  3. In order to effect lawful arrest
  4. To prevent the escape of a person lawfully detained.
  5. For the purpose of suppressing a riot, insurrection or mutiny.
  6. If he dies as a result of a lawful act of war.
