With reference to the nature and classification of law, differentiate between the following:

QUESTION FIVE
a) What is meant by the expression “contractual capacity”? Illustrate your answer with use of
appropriate examples. (4 Marks)
b) Distinguish between a hire purchase contract and a credit sale (6 Marks)
c) Salim appointed Ken to transport fresh fish from Mombasa to Nairobi. As Ken was
preparing to leave Mombasa for Nairobi, it rained heavily and the Thange River Bridge was swept
off.
As a result, Ken chartered a flight to Nairobi to deliver the fish as he feared the fish would go bad
and he was unable to immediately contact Salim. However, upon arrival in Nairobi and delivery
of the fish, Salim refused to reimburse Ken charges for the flight. Ken intends to sue Raju.
